ONS Mail Terms of Service explain the legal terms governing the use of your account, security requirements, subscriptions, Business Mail services, user rights and responsibilities, and the conditions for using our services.

1.1 Purpose of these Terms of Service

These Terms of Service have been prepared to define the rights and obligations relating to the use of all services provided by ONS Mail, govern the legal relationship between users and ONS Mail, and ensure that our services are used in a secure, fair, and lawful manner.

This document sets out the fundamental provisions governing the creation of ONS Mail accounts, the use of our services, user responsibilities, acceptable use rules, security obligations, subscription services, account management, data security, intellectual property rights, suspension or termination of services, and the respective rights and obligations of both parties.

By creating an account or using ONS Mail, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. These Terms apply to all free and paid services provided by ONS Mail, as well as to any existing or future products, features, and services that may be offered.


1.2 Service Provider

The services covered by these Terms of Service are provided by ONS Mail ("ONS Mail", "we", "us", or "our").

ONS Mail is a communication platform that provides secure, privacy-focused, and modern email services. Our services may include web-based email, IMAP and SMTP access, secure messaging, end-to-end encrypted communication features, password-protected emails, self-destructing messages, custom domain support, business email solutions, and other related digital services.

The legal name, registered address, tax information, and other official contact details of the service provider are published on the official ONS Mail website or, where required, on the relevant legal notice pages. Users should use the official communication channels provided by ONS Mail for legal notices, support requests, or other official correspondence.


1.3 Scope

These Terms of Service apply to all services, applications, websites, mobile applications, APIs, software, and related features provided by ONS Mail. This includes free and paid email services, ONS Secure, password-protected emails, self-destructing messages, Calendar, Contacts, Notes, Task Management, IMAP, SMTP and other communication protocols, custom domain services, Business Mail solutions, the Domain Administrator Panel, and any additional products or services that may be introduced by ONS Mail in the future.

These Terms apply to individual users, business customers, domain owners, organization administrators, authorized users, and all natural or legal persons who use ONS Mail services.

Additional terms, subscription agreements, Service Level Agreements (SLAs), security policies, or product-specific conditions may be published for certain services. Such documents shall be considered an integral part of these Terms of Service with respect to the relevant service. In the event of any inconsistency between these Terms and any service-specific terms, the service-specific terms shall prevail.


1.4 Acceptance of these Terms

By creating an ONS Mail account, accessing our services, or using our services in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service, our Privacy Policy, Cookie Policy, and all other applicable policies and agreements.

If you do not agree to these Terms of Service, you must not create an account, access, or continue using ONS Mail services.

If you use the services on behalf of a company, organization, or any other legal entity, you represent and warrant that you have the authority to accept these Terms of Service on behalf of that entity and to legally bind the entity to these Terms.

ONS Mail reserves the right to modify or update these Terms of Service at any time to reflect changes in applicable laws, security requirements, technological developments, or our services. Any revised version becomes effective upon publication and supersedes all previous versions. Where appropriate, material changes may be communicated to users through suitable communication channels. Your continued use of the services after such updates constitutes your acceptance of the revised Terms of Service.

2. Definitions

Unless otherwise expressly stated in these Terms of Service, the following terms shall have the meanings set forth below.

2.1 ONS Mail

ONS Mail refers to the platform, websites, mobile applications, APIs, software, and all related services that provide secure, privacy-focused email and digital communication services to individual and business users.

2.2 User

User refers to any natural person or legal entity that creates an account, accesses, or otherwise uses ONS Mail services.

2.3 Account

Account refers to the user profile created by a user to access ONS Mail services, protected by authentication credentials.

2.4 Service

Service refers to all free and paid products, applications, communication services, software, APIs, and any additional services that may be provided by ONS Mail in the future.

2.5 ONS Secure

ONS Secure refers to the advanced secure communication services provided by ONS Mail. These services may include end-to-end encrypted messaging, password-protected delivery, secure sharing, and similar security features.

2.6 Encrypted Email

Encrypted Email refers to a secure email delivery method that can only be accessed using a password specified by the sender and is protected against unauthorized access.

2.7 Self-Destructing Email

Self-Destructing Email refers to a secure messaging service in which a message automatically becomes inaccessible or is permanently deleted after a period specified by the sender or once predefined viewing conditions have been met.

2.8 Business Mail

Business Mail refers to the professional email service designed for businesses, organizations, and institutions, including custom domain support, user management, enterprise security features, and administrative tools.

2.9 Domain Administrator

Domain Administrator refers to the administrative account authorized to manage mailboxes, user accounts, aliases, security settings, and other administrative functions within one or more assigned domains.

2.10 Domain

Domain refers to the registered Internet domain name used to identify an individual or organization and to create email addresses within ONS Mail services.

2.11 Content

Content refers to all emails, messages, files, attachments, documents, calendar entries, contacts, notes, and any other digital data created, transmitted, received, stored, or shared by users through ONS Mail services.

2.12 Subscription

Subscription refers to a user's enrollment in a free or paid service plan that grants access to the features and benefits included in the selected plan.

2.13 Free Plan

Free Plan refers to the service plan provided by ONS Mail at no cost, offering a limited set of features, storage capacity, and usage limits.

2.14 Paid Plan

Paid Plan refers to any subscription plan offered in exchange for a subscription fee, providing increased storage capacity, advanced security features, additional services, and enterprise administration tools.

3. Acceptance of the Agreement

3.1 Binding Nature of these Terms of Service

These Terms of Service constitute a legally binding agreement between ONS Mail and the user. By creating an ONS Mail account, accessing our services, or using our services in any manner, you agree to be bound by these Terms of Service, our Privacy Policy, Cookie Policy, and all other applicable policies and rules.

You acknowledge that you have carefully read these Terms of Service, understand their contents, and agree to comply with all provisions contained herein. These Terms apply to all current and future free and paid services provided by ONS Mail.

If you do not agree with any provision of these Terms of Service, you must not create an account, access, or continue using ONS Mail services.


3.2 Use of the Service Constitutes Acceptance

By registering for ONS Mail, signing in, accessing any of our services, sending or receiving email, or using any feature provided by ONS Mail, you expressly acknowledge and agree to these Terms of Service.

Your continued use of the services also constitutes acceptance of any future updates to these Terms of Service from their effective date. ONS Mail may notify users of material changes through appropriate communication channels. Continued use of the services after updated Terms have been published constitutes acceptance of the revised version.


3.3 Age Requirement

To use ONS Mail services, you must be of the legal age required to enter into a binding agreement in your country of residence or have obtained the necessary consent from a parent or legal guardian where required by applicable law.

Users who are below the applicable legal age may only use the services under the supervision of their parent or legal guardian and with any legally required authorization. If ONS Mail determines or reasonably suspects that the applicable age requirement has not been met, we may request age verification, temporarily suspend the account, or permanently terminate it.

By creating an account, you represent and warrant that you satisfy the requirements set out in this section.


3.4 Authority and Representation

If you use the services on your own behalf, you represent that you have the legal capacity to accept these Terms of Service.

If you create an account or use ONS Mail services on behalf of a company, organization, institution, association, foundation, or any other legal entity, you represent and warrant that you are authorized to act on behalf of that entity and to legally bind it to these Terms of Service.

Domain Administrators, Business Mail administrators, and other authorized users may act only within the scope of the permissions granted to them. The relevant organization may be responsible, in accordance with applicable law, for the actions taken and instructions given by such authorized users.

Creating accounts on behalf of third parties without authorization, using the services without proper authority, or falsely representing authorization constitutes a violation of these Terms of Service. In such cases, ONS Mail reserves the right to suspend or terminate the relevant account and to take any legal action it considers appropriate.

4. Account Registration and Credentials

4.1 Obligation to Provide Accurate Information

When creating an ONS Mail account or using our services, you must provide information that is accurate, current, complete, and truthful. You are responsible for keeping your account information up to date whenever necessary.

Creating an account using another person's identity, providing false or misleading information, impersonating another individual, or creating an account in a manner that infringes the rights of third parties is strictly prohibited. If ONS Mail determines, or reasonably suspects, that the information provided is inaccurate or fraudulent, we may request account verification, temporarily suspend the account, or permanently terminate it.

For Business Mail and other organizational accounts, individuals acting on behalf of an organization must have the necessary authority and must provide accurate information relating to that organization.


4.2 Account Security

You are primarily responsible for maintaining the security of your ONS Mail account. You are responsible for safeguarding the confidentiality of your username, email address, password, two-factor authentication (2FA) codes, recovery codes, app passwords, and all other authentication credentials associated with your account.

To enhance account security, ONS Mail may provide security features such as two-factor authentication (2FA), session management, device verification, app passwords, security notifications, and similar protection mechanisms. We strongly recommend enabling these security features whenever available.

You are also responsible for securing the devices used to access your account, maintaining up-to-date security software, and taking appropriate measures to prevent unauthorized access to your account.


4.3 Password Responsibility

You are responsible for creating a strong and difficult-to-guess password for your account. We recommend changing your password regularly, avoiding password reuse across different services, and never sharing your password with anyone.

To the extent permitted by applicable law, you are responsible for any loss or damage resulting from your password being compromised due to negligence, carelessness, or failure to adequately protect your credentials.

ONS Mail will never ask you to disclose your current password by email, telephone, text message, or any other unsolicited communication. You should remain vigilant against phishing attempts and enter your credentials only through official ONS Mail login pages.


4.4 Recovery Email Address

To improve account security and facilitate account recovery, you may optionally designate a recovery email address.

You are responsible for ensuring that your recovery email address remains accurate, current, and under your control. ONS Mail is not responsible for account recovery issues arising from loss of access to, or outdated information associated with, your recovery email address.

ONS Mail may use your recovery email address for security verification purposes and may require additional identity verification where necessary.


4.5 Account Sharing

ONS Mail accounts are personal and, unless expressly permitted, may not be shared, transferred, leased, sold, or made available to any other individual or organization.

Users authorized under Business Mail or Domain Administrator services must use only their own accounts and should manage user permissions through the administrative tools provided by ONS Mail. Sharing usernames and passwords among multiple users is discouraged, as it creates significant security risks.

You are responsible for any loss or damage resulting from permitting unauthorized individuals to use your account or from sharing your account credentials.


4.6 Notification of Unauthorized Access

If you believe that your account, password, two-factor authentication credentials, or any other authentication information has been compromised or accessed by an unauthorized person, you must notify ONS Mail without undue delay.

If you detect suspicious login sessions, unknown devices, unusual account activity, or suspect a security breach, you should immediately change your password, terminate active sessions, and update your two-factor authentication settings where applicable.

To protect user accounts and maintain the security of our services, ONS Mail may temporarily restrict an account, require additional identity verification, terminate active sessions, or implement any other appropriate security measures whenever suspicious activity is detected. Such measures are taken to safeguard both user accounts and the integrity of the ONS Mail service infrastructure.

5. Scope of Services

ONS Mail provides secure, privacy-focused, and modern communication solutions for both individual and business users. The scope of our services may vary depending on your subscription plan, technical requirements, geographic location, and the availability of specific services. ONS Mail reserves the right to enhance, modify, restrict, or discontinue any part of its services at any time.

5.1 Email Service

The core service provided by ONS Mail is an electronic mail service that enables users to securely send, receive, store, organize, and manage email communications.

The service may include standard email features such as folder management, archiving, drafts, spam filtering, trash, search, labels, file attachments, and similar functionality. Sending and receiving limits, storage capacity, and available features may vary depending on the user's subscription plan.

5.2 Webmail

ONS Mail may provide a web-based email interface (Webmail) that allows users to securely access their email accounts from compatible devices with an Internet connection, without requiring additional software installation.

The Webmail service may include email management, folder operations, file attachments, contact management, security settings, and other supported features.

5.3 IMAP / SMTP Access

ONS Mail may allow connections from third-party email clients via the IMAP and SMTP protocols for supported subscription plans.

Such access is subject to applicable security policies, authentication requirements, connection limits, and technical specifications. To maintain the security and reliability of the service, ONS Mail may impose restrictions on connection limits, rate limits, authentication methods, or specific email clients.

5.4 Calendar

ONS Mail may provide a digital calendar service that enables users to schedule personal or business events, create meetings, set reminders, and manage calendar data.

5.5 Contacts

The Contacts service enables users to create, edit, store, organize, group, and manage their contact information.

5.6 Notes

ONS Mail may provide a note management service that allows users to create, edit, organize, and securely store personal or business notes.

5.7 Tasks

The Tasks service enables users to create, organize, prioritize, track, and complete tasks through an integrated task management system.

5.8 ONS Secure

ONS Secure includes advanced security features designed for the secure exchange of sensitive information. These services may include end-to-end encrypted communication, secure sharing mechanisms, advanced authentication methods, and other security technologies.

Certain ONS Secure features may only be available under specific subscription plans or technical conditions.

5.9 Encrypted Email

The Encrypted Email service enables the secure delivery of emails protected by a password or other authentication method defined by the sender.

Recipients are not necessarily required to have an ONS Mail account to access encrypted emails. However, the sender is solely responsible for securely sharing the password or authentication method used to protect the message.

5.10 Self-Destructing Email

The Self-Destructing Email service enables secure messages to become inaccessible or be automatically deleted once the sender-defined expiration period, viewing limit, or other specified conditions have been met.

Due to technical limitations, it may not always be possible to prevent recipients from capturing screenshots, manually copying content, or otherwise retaining copies of messages.

5.11 Business Mail

Business Mail is a professional email service designed for companies, organizations, and institutions.

The service may include custom domain support, user and mailbox management, alias management, security policies, administrative tools, Domain Administrator permissions, and other enterprise features.

Available features and usage limits may vary depending on the purchased subscription plan.

5.12 Custom Domain Support

ONS Mail may allow users on eligible subscription plans to connect their own domain names to the email service.

The domain owner is responsible for domain ownership, the accuracy of DNS records, domain renewals, and proper technical configuration. ONS Mail is not responsible for interruptions, delays, or errors caused by third-party domain registrars or DNS providers.

5.13 Future Services

ONS Mail is committed to continuously improving its services. Accordingly, new products, security features, AI-powered tools, collaboration solutions, storage services, communication tools, integrations, APIs, and other digital services may be introduced over time.

Additional terms of use, subscription conditions, or service-specific policies may apply to new services. Unless expressly stated otherwise, such services shall also be governed by these Terms of Service.

ONS Mail reserves the right to modify, restrict, suspend, or permanently discontinue any service, either with prior notice or, where necessary, with immediate effect, due to technical requirements, security considerations, legal obligations, or business reasons.

6. Acceptable Use Policy

ONS Mail is committed to providing a secure, reliable, and privacy-focused communication environment for all users. Accordingly, every user agrees to use ONS Mail services in compliance with applicable laws, principles of good faith, and these Terms of Service.

The activities listed below are provided as examples and are not exhaustive. ONS Mail reserves the right to treat any similar conduct that jeopardizes the security of the services or the rights of other users as a violation of this Acceptable Use Policy.

6.1 Lawful Use of the Services

You agree to use ONS Mail services solely for lawful, legitimate, and authorized purposes in accordance with these Terms of Service.

You are responsible for complying with all applicable laws and regulations in your country of residence, the country in which you use the services, and any applicable international laws.

6.2 Spam Prohibition

ONS Mail services may not be used for:

  • Sending unsolicited bulk email (spam)

  • Bulk promotional or advertising messages

  • Chain emails

  • Automated mass mailing

  • Marketing activities conducted without the recipient's consent

  • Any activity likely to result in blacklisting

If spam activity is detected, ONS Mail may suspend or permanently terminate the relevant account without prior notice.

6.3 Phishing

You may not:

  • Impersonate another individual or organization

  • Create fraudulent login pages

  • Send content designed to collect usernames or passwords

  • Distribute links intended to steal credentials

  • Send emails for fraudulent or deceptive purposes

Phishing activities are strictly prohibited and may result in the immediate termination of your account.

6.4 Distribution of Malware

ONS Mail services may not be used to distribute:

  • Viruses

  • Trojan horses

  • Worms

  • Ransomware

  • Spyware

  • Malicious scripts

  • Malicious attachments

  • Malicious links

  • Redirects intended to facilitate the download of malware

6.5 Fraud

You may not use ONS Mail services for any fraudulent activity, including but not limited to:

  • Financial fraud

  • Cryptocurrency fraud

  • Investment scams

  • Fake promotions

  • Fake giveaways

  • Fraudulent fundraising campaigns

  • Commercial deception

  • Social engineering attacks

6.6 Fake Accounts

Impersonating others, creating accounts using false identity information, creating unauthorized accounts on behalf of another individual or organization, or creating misleading accounts is strictly prohibited.

ONS Mail reserves the right to investigate, verify, suspend, or permanently remove fraudulent or misleading accounts.

6.7 Mass Account Creation

Creating large numbers of accounts through automated or manual methods for the purpose of abusing system resources, exploiting free plans, or operating account-generation systems is prohibited.

ONS Mail may reject suspicious registrations, suspend affected accounts, or permanently delete them.

6.8 Unauthorized Access Attempts

You may not:

  • Attempt to gain unauthorized access to another account

  • Exploit security vulnerabilities

  • Circumvent authentication systems

  • Attempt password cracking

  • Attempt to obtain unauthorized access to data

Such activities are considered serious security violations and may be reported to the appropriate authorities where required.

6.9 Network Attacks

The following activities directed against ONS Mail infrastructure or third-party systems are strictly prohibited:

  • Distributed Denial-of-Service (DDoS) attacks

  • Denial-of-service attempts

  • Network scanning

  • Unauthorized port scanning

  • Traffic manipulation

  • Activities that negatively impact system performance

6.10 Automation and Bot Usage

ONS Mail services may not be used through:

  • Unauthorized bots

  • Automated account creation software

  • Bulk email sending tools

  • Data scraping

  • Unauthorized API usage

  • Automated scripts or robots

Official APIs and integrations provided by ONS Mail may only be used in accordance with their applicable terms and documentation.

6.11 Child Sexual Abuse Material

The creation, storage, transmission, sharing, promotion, or distribution of any content, material, or links involving the sexual abuse, exploitation, or endangerment of children is strictly prohibited.

If such activity is identified, the relevant account may be immediately terminated and appropriate reports may be made to competent authorities as required by applicable law.

6.12 Terrorist Content

Creating, distributing, promoting, financing, supporting, or disseminating content that supports or promotes terrorist organizations or terrorist activities is strictly prohibited.

ONS Mail reserves the right to take any action required under applicable law regarding such content.

6.13 Copyright Infringement

You may not upload, store, distribute, or share content that infringes copyrights, trademarks, patents, trade secrets, or any other intellectual property rights.

Upon receipt of a valid legal notice from a rights holder, ONS Mail may restrict access to the relevant content or take any other action it deems appropriate.

6.14 Illegal Content

ONS Mail services may not be used for:

  • The sale of illegal products or services

  • Smuggling activities

  • Drug trafficking

  • Human trafficking

  • Money laundering

  • Illegal gambling operations

  • Distribution of content prohibited by court order

  • Any other activity prohibited under applicable law

6.15 Violations and Enforcement

If ONS Mail determines or reasonably suspects that this Acceptable Use Policy has been violated, we may, depending on the nature and severity of the violation, take one or more of the following actions without prior notice:

  • Issue a warning

  • Restrict access to specific services

  • Temporarily suspend email sending

  • Temporarily suspend the account

  • Permanently terminate the account

  • Remove or disable access to the relevant content

  • Implement technical protection and security measures

  • Cooperate with competent administrative or judicial authorities where required by applicable law

The enforcement measures described in this section do not limit any other rights or remedies available to ONS Mail under applicable law or these Terms of Service.

7. User Content

ONS Mail provides services that enable users to securely create, store, transmit, and share emails, files, documents, notes, calendar entries, contacts, and other digital content. All rights and responsibilities relating to content created by users or transmitted through the services are governed by the provisions set out below.

7.1 Ownership of Content

All emails, files, documents, images, attachments, contact records, calendar data, notes, and all other user content created, uploaded, sent, received, stored, or shared through ONS Mail services remain the property of the user or the applicable rights holder, unless otherwise required by applicable law. All related intellectual property rights remain with the user or the lawful owner.

ONS Mail performs only those technical operations necessary to provide the services, maintain security, and carry out the user's instructions. Nothing in these Terms of Service shall be interpreted as transferring ownership of, or any intellectual property rights in, user content to ONS Mail.


7.2 User Responsibility

You are solely responsible for all content that you create, upload, send, receive, share, or store through ONS Mail services.

You represent and warrant that all content you share:

  • Complies with applicable laws;

  • Does not infringe the rights of any third party;

  • Respects intellectual property rights;

  • Is used with all necessary permissions and licenses;

  • Does not contain malware or malicious code.

To the extent permitted by applicable law, you are responsible for any claims, liabilities, damages, or losses arising from unlawful content submitted through your account.


7.3 No Ownership Claim by ONS Mail

ONS Mail does not claim ownership of, copyright in, or any other intellectual property rights over user content.

User content is not sold, licensed for commercial purposes, used for advertising, or shared with third parties except where expressly authorized by the user or required by applicable law.

ONS Mail may process user content only to the extent necessary to provide the services, maintain security, perform technical maintenance, comply with legal obligations, and carry out the user's instructions.


7.4 Inaccessibility of Encrypted Content

ONS Mail considers privacy to be a fundamental principle and, where possible, utilizes advanced encryption technologies.

For messages protected through end-to-end encryption within ONS Secure, and for content encrypted using supported security mechanisms, the decryption keys are not stored or maintained by ONS Mail in an accessible form. As a result, ONS Mail cannot access, read, decrypt, or recover the plaintext content of such encrypted communications.

For password-protected emails, users are solely responsible for securely storing the password or other authentication information and delivering it safely to the intended recipient. If the password is lost or forgotten, ONS Mail cannot restore access to encrypted content unless such recovery is technically possible.

For services that do not utilize end-to-end encryption, the security measures applied during transmission, storage, and processing of content may vary depending on the technical architecture of the service and the applicable security policies.


7.5 Lawful Content

You are responsible for ensuring that all content you create, upload, store, transmit, or share through ONS Mail complies with all applicable national and international laws.

The creation, storage, sharing, or transmission of the following types of content is strictly prohibited:

  • Illegal content;

  • Child sexual abuse material;

  • Content promoting or supporting terrorism;

  • Phishing or fraudulent content;

  • Malware or malicious code;

  • Content that infringes copyrights or other intellectual property rights;

  • Content prohibited by a court order;

  • Any other content that constitutes a criminal offense or is prohibited under applicable law.

Where required by applicable law or where a violation of these Terms of Service is identified, ONS Mail may restrict access to the relevant content, suspend the associated account, terminate the service, or cooperate with competent authorities as necessary. Such actions shall not be interpreted as creating a general or continuous obligation for ONS Mail to monitor user content.

8. Privacy and Security

ONS Mail considers user privacy and information security to be fundamental principles of its services. Our services are designed to protect the confidentiality of user data and prevent unauthorized access through the use of internationally recognized security standards, modern encryption technologies, and appropriate technical and organizational security measures. However, no method of data transmission over the Internet or electronic storage can be guaranteed to be completely secure. ONS Mail is committed to implementing reasonable security measures consistent with industry standards.

8.1 Our Privacy Approach

ONS Mail is committed to providing a privacy-focused service that respects the confidentiality of users' personal data and communications.

User emails, files, and other data are processed only as necessary to provide the services, maintain security, comply with legal obligations, and carry out the user's instructions. User data is never sold, marketed, or shared with third parties for advertising purposes unless the user has provided explicit consent or disclosure is required by applicable law.

8.2 End-to-End Encryption

ONS Mail may provide End-to-End Encryption (E2EE) for certain services.

Where end-to-end encryption is available, decryption keys are held solely by the communicating parties. To the extent technically possible, ONS Mail cannot access, read, decrypt, or recover the plaintext content of such encrypted communications.

End-to-end encryption applies only to services that explicitly support this feature. Standard email communications may not provide the same level of protection due to the technical characteristics of email protocols and recipient mail servers.


8.3 Server-Side Security

ONS Mail implements appropriate technical and organizational security measures to protect its service infrastructure.

Depending on the nature of the service, these measures may include:

  • Encrypted data transmission

  • Secure server infrastructure

  • Firewalls

  • Intrusion detection systems

  • Malware protection

  • Spam filtering

  • Security logging

  • Access controls

  • Regular security updates

  • System monitoring and maintenance

Security measures may be updated over time in response to technological developments and emerging threats.


8.4 Two-Factor Authentication (2FA)

ONS Mail may provide Two-Factor Authentication (2FA) to enhance account security.

When 2FA is enabled, users may be required to provide an additional authentication factor in addition to their password. Users are responsible for securely storing their authentication devices, recovery codes, and other authentication credentials.

If recovery codes are lost or access to the authentication device is no longer available, account recovery may require additional identity verification.


8.5 App Passwords

ONS Mail may allow users to generate app passwords for IMAP, SMTP, or other supported email clients.

App passwords should only be used for the specific application or device for which they were created. Users should revoke app passwords that are no longer needed and immediately invalidate any password suspected of being compromised.

ONS Mail may revoke app passwords or require new ones to be generated whenever necessary for security reasons.


8.6 Session Management

Where supported, users may review their active sessions, inspect recognized devices, and terminate active sessions at any time.

If ONS Mail detects suspicious sessions, unusual login attempts, access from unfamiliar geographic locations, or other activities that may pose a security risk, we may terminate active sessions, require additional identity verification, or temporarily restrict account access in order to protect the security of user accounts.


8.7 Security Incidents

ONS Mail implements reasonable technical and organizational measures to prevent, detect, and mitigate security incidents.

If a security incident affecting user data is identified, ONS Mail will assess the incident in accordance with applicable law and, where required, notify affected users and competent authorities within the timeframes required by applicable regulations.

During the investigation of security incidents, temporary account restrictions or additional identity verification procedures may be required.


8.8 User Security Responsibilities

Users are responsible for taking reasonable measures to protect the security of their own accounts.

In particular, users agree to:

  • Use strong and unique passwords;

  • Never share account credentials with third parties;

  • Enable Two-Factor Authentication (2FA) whenever available;

  • Store recovery codes securely;

  • Maintain the security of their devices;

  • Keep operating systems and security software up to date;

  • Remain vigilant against phishing attempts;

  • Promptly report suspicious sessions or potential security incidents to ONS Mail.

To the extent permitted by applicable law, users are responsible for any loss or damage resulting from negligence, disclosure of authentication credentials, or failure to implement appropriate security measures.

9. Storage, Quotas, and Service Limits

To ensure service quality, system security, and fair resource allocation for all users, ONS Mail may apply storage capacities, data transfer limits, and various usage restrictions. These limits may vary depending on the user's subscription plan, technical requirements, system security considerations, and applicable service policies.

ONS Mail reserves the right to update storage quotas and service limits from time to time in order to maintain the stability and continuity of its services.

9.1 Storage Quotas

Each ONS Mail account is allocated a specific amount of storage based on the selected subscription plan.

Storage quotas may include emails, attachments, drafts, trash, spam folders, archives, and other data stored as part of the services.

Free and paid plans may provide different storage capacities. Current storage quotas and plan features are published on the official ONS Mail website or within the user's account dashboard.


9.2 File Size Limits

To maintain system performance and security, ONS Mail may impose maximum file size limits for sent and received emails, including file attachments.

These limits may vary depending on:

  • The user's subscription plan;

  • Technical limitations of the recipient's mail server;

  • The email protocols being used;

  • Applicable security policies.

Messages exceeding the applicable technical limits may fail to send, may not be delivered, or may be rejected by the system.


9.3 Sending Limits

To combat spam, maintain service quality, and prevent abuse of the infrastructure, ONS Mail may impose limits on the number of emails, recipients, simultaneous connections, or data transfers permitted within a specified period.

Sending limits may vary depending on factors including account age, account reputation, subscription plan, verified domain usage, and system security.

If suspicious bulk sending activity or abnormal traffic is detected, outgoing email capabilities may be temporarily restricted.


9.4 Receiving Limits

To protect system performance and security, ONS Mail may apply technical limits relating to incoming email, concurrent connections, data transfer, or storage usage.

Messages identified as spam, malware, or posing other security risks may be automatically rejected, quarantined, or delivered to the spam folder through automated filtering systems.


9.5 Fair Use Policy

ONS Mail services are provided under a Fair Use Policy to ensure balanced, secure, and reliable access for all users.

Users may not:

  • Engage in activities that excessively burden the service infrastructure;

  • Abuse automated bulk sending systems;

  • Use storage capacity for purposes inconsistent with the intended use of the service;

  • Consume system resources in a manner that negatively affects other users;

  • Attempt to bypass security mechanisms.

If unusual usage patterns are detected, ONS Mail may require additional verification, impose temporary usage restrictions, or implement appropriate security measures.


9.6 Exceeding Storage or Usage Limits

If a user exceeds the allocated storage quota or applicable service limits, ONS Mail may take one or more of the following actions:

  • Temporarily suspend the receipt of new email;

  • Prevent new file uploads;

  • Restrict outgoing email functionality;

  • Notify the user to free storage space;

  • Offer the option to upgrade to a higher-capacity subscription plan;

  • Temporarily restrict certain services where technically necessary.

Once the user reduces storage usage or upgrades to an appropriate subscription plan, services may be restored to normal operation where technically feasible.

ONS Mail reserves the right to modify storage quotas and service limits, either with prior notice or immediately in urgent security situations, where necessary to maintain service security, system stability, or compliance with applicable laws.

10. Free and Paid Services

ONS Mail may offer both free and paid subscription plans to meet the needs of different users. Each plan may include different rights, features, storage capacities, security capabilities, administrative tools, and usage limits.

Subscription plans, pricing, features, and applicable conditions may be updated by ONS Mail from time to time.

10.1 Free Plan

ONS Mail may offer a Free Plan that provides access to core email services at no cost.

Services available under the Free Plan may be subject to limitations regarding storage capacity, sending limits, security features, and available tools.

ONS Mail reserves the right to modify or discontinue the scope, technical limitations, or features of the Free Plan with prior notice.


10.2 Paid Plans

ONS Mail may offer various paid subscription plans for individual users and business customers.

Depending on the selected plan, paid subscriptions may include some or all of the following benefits:

  • Increased storage capacity;

  • Higher sending and usage limits;

  • Advanced security features;

  • Access to ONS Secure services;

  • Custom Domain support;

  • Business Mail solutions;

  • Domain Administrator permissions;

  • Priority technical support;

  • Advanced administration and management tools;

  • Additional premium features that may be introduced in the future.

The scope, pricing, and conditions of each paid subscription plan are determined separately by ONS Mail.


10.3 Feature Differences

Free and paid plans may differ with respect to storage capacity, security features, performance limits, management tools, and available services.

Certain features may only be available under specific subscription plans. The availability of a feature in one subscription plan does not guarantee that it will be available in all plans or remain available in the future.

Current plan comparisons and feature lists are published on the official ONS Mail website or within the user's account dashboard.


10.4 Plan Upgrades

Where available, users may upgrade their current subscription to a higher-tier plan.

After payment has been successfully confirmed and any necessary technical processes have been completed, the features and benefits associated with the upgraded plan will become available.

During a plan upgrade, existing user data, emails, and account settings are preserved. However, certain features may require additional configuration or verification before they can be used.


10.5 Plan Downgrades

Users may downgrade their current subscription to a lower-tier plan or to the Free Plan.

Following a downgrade, features that are not included in the new subscription plan may be disabled, and lower storage capacities or usage limits may apply.

If the storage capacity provided by the new plan is lower than the user's current storage usage, ONS Mail may provide a reasonable period for the user to reduce storage usage, organize their data, or upgrade to an appropriate subscription before any action is taken. While storage limits continue to be exceeded, certain services may be temporarily restricted.


10.6 Changes to Subscription Plans

ONS Mail reserves the right to modify subscription plans, pricing, features, and usage limits in response to technological developments, operational costs, security requirements, legal obligations, or business considerations.

Where required by applicable law, users may be notified of significant changes within a reasonable period before such changes take effect.

Continued use of the services after changes become effective constitutes acceptance of the updated subscription terms. If a user does not agree with the changes, they may cancel their subscription or, where available, switch to another subscription plan.

11. Payments and Billing

Paid services offered by ONS Mail are provided in exchange for the fees applicable to the selected subscription plan. The use of paid services is subject to the applicable pricing, payment terms, and the provisions set out in these Terms of Service.

Subscription fees, billing periods, supported payment methods, and other financial terms are published on the official ONS Mail website or within the user's account dashboard.

11.1 Subscription Fees

Subscription fees for paid plans are calculated on a monthly, annual, or other subscription period offered by ONS Mail, depending on the selected plan.

The applicable subscription fee is clearly displayed during the purchase process. By completing the payment, the user agrees to pay the applicable subscription fees.

ONS Mail reserves the right to update pricing for new subscriptions and renewals. Where required by applicable law, users may be notified of price changes before they take effect.


11.2 Renewal

Unless otherwise specified, paid subscriptions expire at the end of the selected subscription period.

For subscriptions where automatic renewal is not enabled, users are responsible for manually renewing their subscription before it expires in order to avoid interruption of the service.

If a subscription expires, certain features included in the paid plan may become unavailable, and the account may be converted to the Free Plan.


11.3 Automatic Renewal

Where supported by the selected payment method, users may enable automatic renewal for their subscription.

When automatic renewal is enabled, the applicable subscription fee will be charged to the registered payment method at the end of each subscription period.

Users may disable automatic renewal at any time through their account settings or any other method made available by ONS Mail. Disabling automatic renewal does not affect the current subscription period, and the subscription will remain active until the end of the paid term.


11.4 Payment Methods

ONS Mail may support various payment methods depending on the country and the services provided.

Supported payment methods may include credit cards, debit cards, bank transfers, digital payment services, cryptocurrency payments, and other electronic payment methods.

Payments may be processed either directly by ONS Mail or through authorized third-party payment service providers. Users represent and warrant that the payment information they provide is accurate, complete, and up to date.


11.5 Failed Payments

If a subscription payment cannot be successfully processed due to payment rejection, insufficient funds, expired payment methods, or similar reasons, ONS Mail may:

  • Retry the payment;

  • Notify the user of the payment failure;

  • Allow a reasonable period for payment to be completed;

  • Temporarily restrict access to paid services;

  • Downgrade the account to the Free Plan;

  • Terminate paid services where necessary.

ONS Mail is not responsible for bank fees, exchange rate differences, or charges imposed by payment providers resulting from failed payment attempts.


11.6 Taxes

Unless expressly stated otherwise, subscription fees may either include or exclude taxes, duties, levies, and other mandatory charges applicable under relevant tax laws.

Users are responsible for any additional taxes or fiscal obligations applicable in their country or jurisdiction as required by applicable law.

Where legally required, ONS Mail may issue invoices, generate electronic invoices, and maintain tax-related records in accordance with applicable legal requirements.


11.7 Refund Policy

Requests for refunds relating to paid services are evaluated in accordance with applicable consumer protection laws, the nature of the purchased service, and ONS Mail's applicable Refund Policy.

Cancellation of a subscription by the user does not automatically entitle the user to a refund for the current subscription period.

In cases involving technical errors, duplicate charges, incorrect billing, or where refunds are required under applicable law, ONS Mail may, after conducting the necessary review, issue a refund where appropriate.

Processing times, delays, or additional fees imposed by payment service providers, banks, or other third-party financial institutions are outside the control of ONS Mail, and responsibility for such matters rests with the relevant payment provider.

12. Business Mail and Domain Administrator

ONS Mail may provide Business Mail services for businesses, organizations, and institutions, including custom domain support, organizational user management, and Domain Administrator permissions. The use of these services is subject to these Terms of Service and the applicable subscription plan.

Domains, user accounts, and administrative functions created under the Business Mail service must be managed in accordance with the provisions of this section.

12.1 Responsibilities of Domain Owners

The domain owner or the authorized organization using the Business Mail service represents and warrants that it:

  • Is the lawful owner or authorized user of the domain name;

  • Holds all necessary rights relating to the domain;

  • Will properly configure the required DNS records;

  • Will renew the domain registration before its expiration;

  • Is responsible for the management of user accounts created under the domain;

  • Will ensure that all activities conducted through the domain comply with applicable laws.

ONS Mail is not responsible for service interruptions or technical issues resulting from domain expiration, incorrect DNS configuration, or failures caused by third-party domain registrars or DNS providers.


12.2 Domain Administrator Permissions

A Domain Administrator is authorized to manage only the domain or domains explicitly assigned to that administrator.

Subject to the applicable subscription plan, a Domain Administrator may be permitted to:

  • Create, update, and remove user accounts;

  • Manage mailboxes;

  • Configure aliases and email forwarding;

  • Manage storage quotas;

  • Configure domain security settings;

  • Assign administrative permissions;

  • Monitor service usage;

  • Manage organizational configurations.

A Domain Administrator may act only within the scope of the permissions granted. In the event of misuse of administrative privileges or actions exceeding authorized permissions, ONS Mail reserves the right to implement appropriate security measures.


12.3 User Management

The management of user accounts created under the Business Mail service is the responsibility of the relevant organization.

The organization is responsible for:

  • Creating user accounts;

  • Assigning permissions;

  • Suspending accounts;

  • Deleting accounts;

  • Enforcing password policies;

  • Managing security settings.

Administrators authorized by the organization are responsible for the administrative actions they perform and the instructions they issue regarding user accounts.


12.4 Organizational Policies

Business Mail users must comply not only with these Terms of Service but also with the information security, privacy, data protection, and communication policies established by their own organization.

ONS Mail does not create, manage, or enforce an organization's internal policies or procedures. The preparation, implementation, and communication of organizational policies are the sole responsibility of the relevant organization.

Any administrative or legal liability arising from violations of organizational policies may rest with the relevant user and/or organization in accordance with applicable law.


12.5 Domain Ownership Verification

To activate the Business Mail service, ONS Mail may require verification of domain ownership.

Verification may be completed using DNS records, verification tokens, domain configuration methods, or any other technically appropriate verification mechanism.

Until verification has been successfully completed, ONS Mail may postpone activation of the service for the relevant domain, restrict certain features, or reject the service request if verification cannot be completed.

Providing false, misleading, or fraudulent domain ownership information, attempting to add domains belonging to third parties without authorization, or abusing the verification process constitutes a violation of these Terms of Service. In such cases, ONS Mail reserves the right to suspend or terminate the relevant services and to take any legal action it considers appropriate.

13. Intellectual Property Rights

All software, designs, trademarks, logos, visual materials, user interfaces, source code, documentation, content, and all other intellectual property owned or used by ONS Mail are protected under applicable copyright, trademark, patent, and other intellectual property laws.

Under these Terms of Service, users are granted only a limited, revocable, non-exclusive, and non-transferable license to use the services. Nothing in these Terms shall be construed as transferring any ownership of ONS Mail's intellectual property rights to the user.

13.1 Software

All software, applications, web interfaces, mobile applications, APIs, algorithms, source code, object code, database structures, and other software components developed or licensed by ONS Mail are owned by ONS Mail or the applicable rights holders.

Users may not:

  • Copy the software;

  • Modify the software;

  • Reverse engineer the software;

  • Attempt to derive or access the source code;

  • Reproduce the software;

  • Distribute the software;

  • Sell the software;

  • Lease or rent the software;

  • Grant sublicenses;

or otherwise claim any rights in the software except where such rights cannot legally be restricted under applicable law.


13.2 Design

All intellectual property rights relating to ONS Mail's websites, user interfaces, graphics, icons, page layouts, color schemes, visual identity, user experience (UX) designs, and other design elements belong to ONS Mail or the applicable rights holders.

These materials may not be copied, reproduced, imitated, or used for commercial purposes without the prior written permission of ONS Mail.


13.3 Logos

The names, logos, icons, product logos, and other distinctive visual identifiers of ONS Mail are trademarks and brand assets owned by ONS Mail.

Users and third parties may not:

  • Use these logos in a misleading manner;

  • Modify or alter them;

  • Imitate or reproduce them;

  • Use them to promote their own products or services;

  • Use them in any manner that suggests sponsorship, endorsement, or affiliation with ONS Mail.

Commercial use of ONS Mail logos is prohibited unless expressly authorized in writing.


13.4 Trademarks

"ONS Mail," "ONS Secure," and all other product names, service names, trademarks, service marks, trade names, and other distinctive identifiers used by ONS Mail are protected under applicable trademark and intellectual property laws.

Unauthorized use, reproduction, imitation, registration, or attempted registration of these marks is strictly prohibited.


13.5 Trade Names

The trade names, business names, domain names, and other corporate identity elements associated with ONS Mail are protected under applicable intellectual property and commercial laws.

Users may not use similar trade names, domain names, or branding elements in a manner that could create confusion or imply any affiliation with ONS Mail.


13.6 Copyright

All text, graphics, documentation, help materials, software code, databases, designs, images, videos, and other content available through ONS Mail's websites, applications, and services are protected by copyright law.

Except as expressly permitted by applicable law, users may not, without ONS Mail's prior written consent:

  • Copy;

  • Reproduce;

  • Publish;

  • Distribute;

  • Modify;

  • Use such content for commercial purposes.

Copyright ownership of user-generated content remains with the applicable user or rights holder, as described in Section 7 – User Content.


13.7 Licenses

ONS Mail grants users a limited, personal, revocable, non-exclusive, and non-transferable license solely for the purpose of accessing and using the services.

This license does not permit:

  • Reselling the services;

  • Renting or commercially leasing the services;

  • Granting sublicenses;

  • Unauthorized reproduction of the services;

  • Creating derivative works based on the services;

  • Any interpretation that ownership of ONS Mail's intellectual property rights has been transferred to the user.

Where third-party open-source software or licensed components are incorporated into the services, their respective license terms shall apply independently. These Terms of Service do not replace, modify, or supersede any applicable third-party licenses.

ONS Mail reserves the right to pursue any legal or technical remedies available under applicable law in the event of any infringement of the intellectual property rights described in this section.

14. Third-Party Services

To provide its services, maintain security, and enhance the user experience, ONS Mail may integrate with various third-party service providers, software solutions, and technical infrastructures. These services may include systems that are not operated directly by ONS Mail and may be subject to the respective terms of service and privacy policies of those third parties.

While ONS Mail exercises reasonable care in selecting third-party service providers, ONS Mail is not responsible, to the extent permitted by applicable law, for interruptions, errors, or other issues arising from systems or services outside its direct control.

14.1 Domain Providers

Users utilizing Business Mail or Custom Domain services may register or manage their domain names through third-party domain registrars.

The following responsibilities remain with the applicable domain registrar or domain owner:

  • Domain registration;

  • Domain renewal;

  • Maintenance of domain ownership;

  • Domain transfers;

  • Domain suspension or cancellation.

ONS Mail is not responsible for service interruptions, registration errors, expired domains, or similar issues resulting from third-party domain registrars.


14.2 DNS Services

Proper operation of ONS Mail services may require users to correctly configure certain DNS records.

The creation, modification, updating, or deletion of DNS records is the responsibility of the user or the domain administrator.

Incorrect DNS configurations may result in email delivery failures, authentication errors, or service interruptions. ONS Mail is not responsible for issues caused by incorrect DNS configurations made by the user.


14.3 Payment Infrastructure

Payments for paid services may be processed either directly by ONS Mail or through authorized third-party payment service providers.

Financial information submitted during the payment process may be processed in accordance with the applicable security standards, terms, and policies of the relevant payment provider.

ONS Mail is not responsible for matters arising from banks, payment processors, or financial institutions, including:

  • Transaction delays;

  • Technical failures;

  • Payment declines;

  • Currency exchange fluctuations;

  • Processing fees or commissions;

  • Banking service interruptions.

Such matters are outside the control of ONS Mail and remain the responsibility of the relevant payment service provider.


14.4 Security Services

To protect user accounts and service infrastructure, ONS Mail may utilize various third-party security technologies and security services.

These services may include:

  • Bot protection systems;

  • Spam filtering solutions;

  • Malware detection services;

  • Security verification services;

  • Network security solutions;

  • DDoS protection services;

  • Certificate management and encryption infrastructure.

The use of these services does not affect the processing of user data in accordance with the ONS Mail Privacy Policy and applicable law.


14.5 External Integrations

ONS Mail may integrate with third-party applications, email clients, APIs, and other services to improve the functionality and usability of the platform.

The use of such integrations is entirely at the user's discretion.

The following aspects of third-party applications remain the responsibility of the respective provider:

  • Security;

  • Privacy practices;

  • Data processing methods;

  • Service availability;

  • Performance.

Users are responsible for periodically reviewing the permissions granted to third-party applications and revoking access that is no longer required.


14.6 Limitation of Liability for Third-Party Services

ONS Mail does not directly control the operations of third-party service providers and does not guarantee that such services will operate without interruption, error, or continuous availability.

To the fullest extent permitted by applicable law, ONS Mail shall not be liable for consequences arising from third-party services, including:

  • Service interruptions;

  • Data loss;

  • Security incidents;

  • Technical failures;

  • Changes to third-party policies;

  • Discontinuation of third-party business operations.

ONS Mail reserves the right to replace third-party service providers, introduce new integrations, or discontinue existing integrations at any time in order to improve service quality, enhance security, or comply with applicable legal requirements.

15. Suspension and Termination of Services

To protect the security and integrity of its services and the rights of other users, ONS Mail may temporarily suspend user accounts, restrict access to specific services, or permanently terminate accounts where necessary. This section governs users' rights to close their accounts and ONS Mail's authority to suspend or terminate services.

15.1 User-Initiated Account Closure

Users may request the closure of their ONS Mail account at any time.

Upon account closure:

  • Access to the account may be terminated;

  • Services associated with the account may be disabled;

  • Paid subscriptions may be cancelled;

  • The ability to send and receive emails may be discontinued.

Account deletion and the removal of personal data will be carried out in accordance with the ONS Mail Privacy Policy, applicable law, and any mandatory legal data retention requirements.

Users are strongly encouraged to back up any important data before closing their accounts.


15.2 Suspension by ONS Mail

ONS Mail may temporarily suspend an account, including but not limited to, in the following circumstances:

  • Violation of these Terms of Service;

  • Detection of spam or service abuse;

  • Phishing attempts;

  • Distribution of malware;

  • Suspected security incidents;

  • Unauthorized access attempts;

  • Fraudulent activities;

  • Binding requests from competent legal authorities;

  • Activities that threaten the security or stability of the service infrastructure;

  • Failure to fulfill payment obligations;

  • Failure to complete required domain ownership or account verification procedures.

During the suspension period, users may lose access to all or part of their account and services.


15.3 Temporary Restrictions

Where full account suspension is not necessary, ONS Mail may temporarily restrict specific services.

Such restrictions may include:

  • Suspension of outgoing email;

  • Temporary restrictions on receiving new email;

  • Disabling IMAP or SMTP access;

  • Restricting API access;

  • Temporarily removing Domain Administrator privileges;

  • Restricting account access until required security verification has been completed.

Temporary restrictions may be lifted once the security risk has been resolved or the required verification procedures have been successfully completed.


15.4 Permanent Termination

ONS Mail reserves the right to permanently terminate a user account under circumstances including, but not limited to:

  • Serious or repeated violations of these Terms of Service;

  • Participation in illegal activities;

  • Creation, possession, or distribution of child sexual abuse material;

  • Support for terrorist activities;

  • Phishing or fraudulent activities;

  • Persistent spam distribution;

  • Attacks against the ONS Mail infrastructure;

  • Use of false identity information or fraudulent organizational information;

  • Binding orders issued by competent legal authorities.

Permanently terminated accounts may not be reinstated. Subject to applicable legal retention requirements, account data may be deleted or irreversibly anonymized in accordance with ONS Mail's data retention policies.


15.5 Emergency Security Measures

To protect user accounts, service infrastructure, and other users, ONS Mail may implement immediate security measures without prior notice in emergency situations.

Such measures may include:

  • Temporarily locking an account;

  • Terminating active sessions;

  • Requiring a password reset;

  • Re-enabling or requiring Two-Factor Authentication (2FA);

  • Blocking suspicious devices;

  • Suspending outgoing email;

  • Revoking API keys or app passwords;

  • Temporarily removing Domain Administrator privileges;

  • Temporarily disabling specific services for security purposes.

ONS Mail applies these measures solely to protect users, service infrastructure, and third parties from security risks. Once the identified risk has been resolved, ONS Mail will take reasonable technical and legal steps to restore access to affected services where feasible.

16. Service Availability

ONS Mail strives to provide its services with the highest possible standards of availability, reliability, and performance. However, interruptions or changes to the services may occur from time to time due to scheduled maintenance, security requirements, infrastructure upgrades, or events beyond ONS Mail's reasonable control.

ONS Mail is committed to implementing reasonable technical and organizational measures to maintain service continuity. However, ONS Mail does not guarantee that its services will be uninterrupted, error-free, or continuously available.

16.1 Scheduled Maintenance

ONS Mail may perform scheduled maintenance to improve system performance, apply security updates, introduce new features, and enhance its infrastructure.

During scheduled maintenance:

  • Access to the services may be temporarily restricted;

  • Certain features may be unavailable;

  • Performance may be temporarily reduced;

  • Certain administrative functions may be temporarily suspended.

Where reasonably possible, scheduled maintenance will be announced in advance. However, prior notice may not always be possible where security or technical circumstances require immediate action.


16.2 Emergency Maintenance

ONS Mail may perform emergency maintenance without prior notice where necessary to protect service security, data integrity, or system stability.

Emergency maintenance may be required in situations including:

  • Remediation of critical security vulnerabilities;

  • Cyberattacks;

  • Technical issues affecting data integrity;

  • Hardware failures;

  • Software defects;

  • Urgent infrastructure interventions.

During emergency maintenance, all or part of the services may be temporarily unavailable.


16.3 Service Interruptions

Although ONS Mail exercises reasonable care to maintain service availability, interruptions may occur due to circumstances including:

  • Internet infrastructure failures;

  • Data center outages;

  • Power failures;

  • Network connectivity issues;

  • Failures involving third-party service providers;

  • Hardware or software malfunctions;

  • Security incidents;

  • Scheduled or emergency maintenance.

ONS Mail will use reasonable efforts to restore affected services as quickly as practicable.


16.4 Force Majeure

ONS Mail shall not be liable for delays or service interruptions resulting from events beyond its reasonable control that prevent or substantially impair the provision of its services.

Force majeure events include, but are not limited to:

  • Natural disasters;

  • Earthquakes;

  • Floods;

  • Fires;

  • Pandemics or widespread infectious diseases;

  • War;

  • Acts of terrorism;

  • Civil unrest;

  • Strikes or labor disputes;

  • Widespread failures of electrical or telecommunications infrastructure;

  • Government actions;

  • Court orders;

  • Cyberattacks;

  • Large-scale failures affecting third-party infrastructure.

In such circumstances, ONS Mail will make reasonable efforts to restore the affected services as soon as reasonably practicable.


16.5 Changes to the Services

ONS Mail reserves the right to modify, improve, update, restructure, or discontinue its services in response to technological developments, security requirements, user needs, legal obligations, or business considerations.

Accordingly, ONS Mail may:

  • Introduce new features;

  • Modify existing features;

  • Discontinue specific services;

  • Update usage limits;

  • Revise security policies;

  • Upgrade or replace service infrastructure;

  • Restructure subscription plans.

Where required by applicable law, users may be notified of significant changes within a reasonable period before such changes become effective.

Continued use of ONS Mail services after such changes become effective constitutes acceptance of the revised services. Users who do not agree with the changes may close their accounts or terminate their subscriptions, as applicable.

17. Limitation of Liability

ONS Mail endeavors to provide its services with reasonable care, technical competence, and security measures consistent with industry standards. However, to the fullest extent permitted by applicable law, ONS Mail's liability is limited as set out in this section.

The limitations contained in this section do not apply in cases involving willful misconduct, gross negligence, or any liability that cannot be limited or excluded under applicable law.

17.1 Indirect Damages

To the fullest extent permitted by applicable law, ONS Mail shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

  • Loss of profits;

  • Loss of business opportunities;

  • Business interruption;

  • Loss of reputation or goodwill;

  • Loss of anticipated earnings;

  • Economic losses arising from the use or loss of data;

  • Indirect claims asserted by third parties.

You acknowledge and agree that you use ONS Mail services at your own risk.


17.2 Data Loss

ONS Mail implements reasonable technical and organizational measures to protect user data. However, data loss may occur as a result of:

  • Hardware failures;

  • Software defects;

  • User error;

  • Unauthorized access;

  • Cyberattacks;

  • Force majeure events;

  • Technical failures involving third-party service providers.

Users are responsible for maintaining regular backups of any important data. To the fullest extent permitted by applicable law, ONS Mail shall not be liable for the loss of user data that has not been independently backed up by the user.


17.3 Service Interruptions

Although ONS Mail strives to provide uninterrupted services, temporary interruptions may occur due to maintenance, technical failures, security incidents, Internet infrastructure issues, or other technical circumstances.

To the fullest extent permitted by applicable law, ONS Mail shall not be liable for:

  • Temporary inability to access the services;

  • Delays in email delivery;

  • Synchronization issues;

  • Temporary reductions in performance;

  • Temporary unavailability of certain features.


17.4 Issues Arising from Third-Party Services

In providing its services, ONS Mail may rely on third-party domain registrars, DNS providers, payment processors, Internet service providers, data centers, cloud infrastructure providers, and other third-party service providers.

To the fullest extent permitted by applicable law, ONS Mail shall not be liable for issues arising from such third-party services, including:

  • Service interruptions;

  • Connectivity problems;

  • DNS errors;

  • Payment processing failures;

  • Security incidents;

  • Data center outages;

  • Software failures affecting third-party systems.

Such matters are beyond the direct control of ONS Mail.


17.5 Disclaimer of Warranties

To the fullest extent permitted by applicable law, ONS Mail services are provided on an "AS IS" and "AS AVAILABLE" basis.

ONS Mail does not warrant that:

  • The services will operate without interruption;

  • The services will always be available;

  • All errors or defects will be corrected;

  • The services will be fully compatible with every device;

  • The services will satisfy every user expectation;

  • The services will be entirely free from security risks;

  • The services will remain continuously compatible with third-party systems.

Nevertheless, ONS Mail will continue to make reasonable efforts to improve service quality, strengthen security, and resolve technical issues.

Nothing in this section limits or excludes any rights that users may have under mandatory consumer protection laws or other provisions of applicable law that cannot legally be limited or waived.

18. Indemnification

Users agree to use ONS Mail services in compliance with applicable laws, these Terms of Service, and the rights of third parties. If a user's violation of these obligations causes ONS Mail to suffer loss or results in claims being brought against ONS Mail by third parties, the provisions of this section shall apply.

This section applies only to the extent permitted by applicable law and does not limit or waive any non-excludable rights granted to users under mandatory legal provisions.

18.1 Circumstances Requiring User Indemnification

To the fullest extent permitted by applicable law, the user agrees to indemnify ONS Mail for losses, damages, costs, and reasonable expenses arising from:

  • Violation of these Terms of Service;

  • Unauthorized or improper use of the user's account;

  • False, inaccurate, or misleading information provided by the user;

  • Infringement of intellectual property rights;

  • Use of ONS Mail services for unlawful purposes;

  • Violation of the rights of third parties;

  • Activities intended to misuse or compromise security systems;

  • Any other unlawful acts or omissions attributable to the user.

Indemnifiable losses may include reasonable attorneys' fees, court costs, reasonable expenses arising from administrative proceedings or regulatory actions, and direct damages incurred by ONS Mail.


18.2 Unlawful Use

If a user uses ONS Mail services for:

  • Criminal activities;

  • Spam distribution;

  • Phishing attacks;

  • Fraudulent activities;

  • Distribution of malware;

  • Unauthorized access attempts;

  • Child sexual abuse material;

  • Terrorist activities or propaganda;

  • Intellectual property infringement;

  • Any other purpose that violates applicable law,

and such use causes ONS Mail to suffer loss or damage, the user shall be responsible, to the fullest extent permitted by applicable law, for the resulting damages.

ONS Mail reserves the right to suspend or terminate the relevant account and, where required or appropriate, cooperate with competent legal or regulatory authorities.


18.3 Third-Party Claims

If legal proceedings, administrative actions, claims for damages, or similar proceedings are brought against ONS Mail as a result of a user's actions or omissions, and the user is determined to be at fault, ONS Mail may seek reimbursement, to the fullest extent permitted by applicable law, for its direct damages and reasonable legal defense costs.

Legal responsibility for user-generated content, activities performed by the user, and actions carried out through the user's account remains primarily with the relevant user in accordance with applicable law.

Nothing in this section limits any other rights or remedies available to ONS Mail under applicable law or restricts ONS Mail's right to pursue any legal or administrative action it considers appropriate.

19. Privacy and Personal Data

ONS Mail considers user privacy to be one of its core values and is committed to processing personal data in accordance with applicable data protection laws. The collection, use, storage, protection, and, where necessary, disclosure of personal data are governed by these Terms of Service together with the ONS Mail Privacy Policy.

19.1 Reference to the Privacy Policy

By using ONS Mail services, you also agree to the ONS Mail Privacy Policy and any other applicable data protection policies in addition to these Terms of Service.

21.1 Governing Law

Unless mandatory provisions of applicable law require otherwise, these Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Türkiye.

Nothing in these Terms shall affect the application of mandatory consumer protection laws, data protection legislation, or other mandatory legal provisions applicable in the user's country of residence.

For international users, where a conflict exists between these Terms of Service and mandatory provisions of applicable law, the mandatory legal provisions shall prevail.


21.2 Competent Courts

The parties agree to make reasonable efforts to resolve any dispute arising out of or relating to these Terms of Service or the use of ONS Mail services through good-faith negotiations before initiating formal legal proceedings.

If a dispute cannot be resolved amicably, and unless mandatory applicable law provides otherwise, the courts and enforcement offices of the Republic of Türkiye shall have jurisdiction.

For users acting as consumers, mandatory provisions granting jurisdiction to the consumer's local courts, consumer arbitration boards, or other competent authorities under applicable consumer protection laws shall remain unaffected.


21.3 Alternative Dispute Resolution

Where appropriate, ONS Mail supports the resolution of disputes through negotiation, settlement discussions, mediation, or other alternative dispute resolution mechanisms before court proceedings are initiated.

Users are encouraged to first contact ONS Mail's support or legal department in an effort to resolve disputes amicably.

Where permitted or required under applicable law, disputes may also be referred to consumer arbitration boards, mediation services, online dispute resolution platforms, or other alternative dispute resolution mechanisms.

Nothing in this section limits the right of either party to initiate legal proceedings, submit administrative complaints, or exercise any other legal rights available under applicable law.

If any provision of these Terms of Service is determined to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall remain in full force and effect. Any invalid or unenforceable provision shall be interpreted or replaced, where possible, in a manner that most closely reflects the original intent of the parties while remaining legally enforceable.

Failure or delay by ONS Mail in exercising any right under these Terms of Service shall not constitute a waiver of that right.
